This website and the digital products sold through Summit Themes are operated by The Choplin Group LLC ("we", "us", "our"), based in Lafayette, Louisiana. By using this website, purchasing, downloading, or accessing any Summit Themes product, you agree to these Terms of Service.

Website and products

Summit Themes provides digital website themes, templates, source code, documentation, and related assets (the "Products"). Products are delivered electronically. No physical goods are shipped.

The website and Products are provided as-is. We may update pricing, features, copy, previews, product availability, and documentation at any time.

Purchases and delivery

Checkout, payment processing, invoices, and applicable tax handling may be provided by Polar (polar.sh) or another checkout provider acting as merchant of record. That provider's terms govern the payment transaction and handling of payment data.

After purchase, you receive access to the Product files, updates, and any included support according to the license or product terms shown at checkout.

License

Your use of any Product is governed by the Summit Themes License and any license file included with the download. In plain English: you may use purchased Products to build websites for yourself or clients, but you may not resell, redistribute, sublicense, publish, mirror, share, or expose the Product source files as a template, starter, package, generator, repository, or competing product.

Refunds

Refund requests are handled under our Refund Policy. Because Products are digital source code that cannot be returned, refunds may be declined for abuse, including requests made after downloading, accessing private repositories, deploying a production site, or otherwise retaining the Product while requesting a refund.

Intellectual property

All Products, previews, documentation, copy, design systems, and related materials are owned by The Choplin Group LLC or its licensors. Except for the rights granted by your license, no ownership rights are transferred to you.

Limitation of liability

To the maximum extent allowed by law, Summit Themes and The Choplin Group LLC are not liable for indirect, incidental, consequential, special, or punitive damages, lost profits, lost revenue, loss of data, or business interruption arising from use of the website or Products.

Changes

We may update these Terms from time to time. Continued use of the website or Products after updates means you accept the revised terms.

Governing law

These Terms are governed by the laws of the State of Louisiana, USA, without regard to conflict-of-law rules. Venue for disputes will be in courts serving Lafayette, Louisiana, unless applicable law requires otherwise.
